As long as the divorce is 100% final and you have a copy of the papers to prove that you are divorced, there shouldn’t be a waiting time to remarry.

According to the Census, January is the month when the most divorces are filed, with 90% of them being done by women. For men filing for divorce, it’s June.

Maybe it’s because women put “Get divorced” on their new years resolution list…j/k. Don’t really know, but that is a weird statistic.

My dad and stepmom married in Greece, then moved to Arizona. My dad is a U.S. citizen, however my stepmom is not. They never registered their marriage in Arizona, and did not apply for my stepmom to become a U.S. Citizen. My stepmom filed for a divorce, and now lives in Texas. Would they still have to get a divorce as they never did register their marriage in the U.S. or Arizona?

I make too much money for him to continue to qualify and his benefit pays for his caregiver (almost)..

Maybe but if all the records of the marriage are in the Philippines and he lives there then it might be difficult. If he is resident in the US and they recognise the marriage then he could.

I need to file Divorce – probably cause forms to my husband who is temp residing in Hawaii, does that make a difference in the outcome?

No it won’t. If you file in California than he has to come to CA if the courts call him to court. The first person who files for divorce has a bit more leg to stand on when it comes to the terms of the divorce.

But beware..if he can not afford to represent himself with a lawyer he can request the courts to force you to pay for all his lawyer fee’s and travel expenses since you were the one to ask for the divorce and file in the first place.

There is a form you can find on the internet, You have to fill these out and turn them in. You will have to go in front of a judge. My daughter did this and was divorced withing minutes.

Or can I just show up at the clerks office in 6 months and say “we’ve been separated for 6 months now, give me a divorce”?

Also, could the fact that he’ll have been in jail for 6 months and 20 days (by the time he gets out) “prove” we’ve been separated on it’s own without having to file separation papers?

VA requires a period of legal separation before you divorce so you can’t just show up and claim to have lived apart for 6 months.
